Fox Legal Expert Suggests Obama Could Be Impeached over the Sequester – Even Though It Was Voted into Law with 202 Republican Votes

Fox News legal analyst Andrew Napiltano suggested yesterday that Pres. Obama could be impeached over the sequester:

“This is almost an impeachable offense,” Napolitano [said]. “If the president is deciding how to spend money in order to hurt us, rather than in order to provide us with the services for which we have paid and for which we have hired him, he is doing the opposite of what he has taken an oath to do.”

“He has taken an oath to uphold the laws. That means make the government work. Don’t make it painful, find a way to make it work on 2 percent less.”

The former judge concluded: “That’s the way the constitution works!”

What this Fox legal expert deliberately pretends to ignore, of course, is that impeachment over the sequester would put holdovers among the 174 Republicans in the House and 28 Republicans in the Senate who voted for the sequester in the 112th Congress in a very awkward position. In particular, it would make a majority of House Republicans complicit in the president’s “crime.”

“Send the liberal detractors a message that not only does Marco Rubio inspire you…he hydrates you too.” — Nonsensical call to action from the Reclaim America PAC, Sen. Marco Rubio’s political action committee that raises money to elect conservatives to the Senate.

For a minimum donation of $25, Rubio’s supporters can buy a water bottle with his name on it and thereby scare thirsty liberals. As inexplicable as the message itself is the fact that the photo and caption have received over 71,000 “Likes” on Facebook (and counting).

In the few short weeks he has been in Congress, newly elected Texas Republican Sen.Ted Cruz has been caught repeatedly making false insinuations and embedding outright lies in his questioning of witnesses during committee hearings. Most of those on the receiving end of Cruz’ smears were Democrats, of course, but he also attacked Republican former Sen. Chuck Hagel, whom Pres. Obama has nominated to be defense secretary.

“We do not know, for example, if he received compensation for giving paid speeches at extreme or radical groups,” Cruz said, during Hagel’s confirmation hearing. It’s these sorts of tactics that are drawing comparisons — by MSNBC’s Chris Matthews and others — between Cruz and “Tailgunner Joe” McCarthy, the Wisconsin Republican senator who brought lasting shame to the GOP with his commie witch hunts during the Republicans’ “red scare” era in the 1950s.

McCarthy was infamous for claiming he had various lists of commies who had infiltrated the government. He consistently refused to release the lists, and the number of names on the lists changed every time he made the claim. Cruz’ insinuation against Hagel during the confirmation hearing was so sleazy that it drew a hand slap from Hagel’s number one arch-frenemy, Sen. John McCain.

But now the New Yorker’s Jane Mayer has uncovered a bona fide McCarthyite lie that Cruz told at a right-wing political rally in 2011. At the event, which was sponsored by a Koch brothers group, Cruz claimed that during his years in law school at Harvard, from 1992 to 1995, there were no less than a dozen treasonous communists on the faculty:
